Azizul Ashraf Bin Abdul Aziz
Graduated from International Islamic University Malaysia in 2006 and was called to the Bar on 29th November 2007. He had undergone his pupilage at Messrs Aziz Hon Annuar. He later joined Messrs Zulpadli & Edham on 3rd December 2007 as Legal Assistant to develop his skills both in litigation and advocacy both in banking and general matters. Starting from September 2016, he had been promoted as a Partner in charge of Banking Litigation Department.
Litigation
Recovery of debt involving civil action until judgment for housing loan, personal loan, term loan, educational loan, hire purchase, Islamic Loan facility, credit card facility, overdraft facility, bridging loan etc. He had handled cases for various banks i.e Bank Muamalat Malaysia Berhad, Malaysia Building Society Berhad, Bank Simpanan Nasional, Bank Kerjasama Rakyat Malaysia, Affin Bank Berhad, Bank Islam Berhad, Al-Rajhi Bank, RHB Bank Berhad etc.
In summary, Azizul Ashraf had the following experience in Litigation:-
- Experienced in recovery of debt for Islamic Financial Institution involving various types of Islamic product including Bai’ Bithaman Ajil, Bai’ Al-Inah, AITAB, Musyarakah Mutanaqisah, Mudharabah, Tawarruq, Istisna’, Qardhul Hassan, Ijarah Muntahiyyah Bittamlik, etc.
- Experienced in handling general litigation matter on defamation suit.
- Experienced in handling civil cases relating to High Court and Land Office foreclosure proceedings, private auctions and post-auction procedures.
- Experienced in handling contested matters in foreclosure proceedings.
- Experienced in handling execution proceedings such as Bankruptcy, Winding –up, Garnishee Proceedings, Judgment Debtor Summons, Writ Seizure & Sale etc.
- Experienced in handling case on probate and letter of administration.
- Preparing and rendered opinion and legal advice pertaining to Banking Litigation Issues and various aspects of legal matters.
- Able to handle contested matters on Bankruptcy and Winding-up.
- Conducting the auction via private auction, land office and high court auction.
- Conducting hearing of interlocutory application (summary judgment, striking out, injunction, setting aside) for dispute on banking debt.
- Conduction hearing for committal proceedings.
- Attending to execution proceedings such as Bankruptcy, Winding Up of companies, Writ of Distress, Writ Seizure and Sale, Judgment Debtor Summons, Garnishee etc.
- Attending to retail banking facilities recovery of debts collection arising from personal loan, credit card facilities, hire purchase and other normal retail banking litigation.
- Attending and conducting full trial in civil cases.
